1. Purpose and Scope of the Policy

The primary purpose of this Clarification Text on the Processing of Personal Data (“Clarification Text”) (İşbu Kişisel Verilerin İşlenmesine İlişkin Aydınlatma Metni) is to present the following explanations to our valued visitors and customers in order to fulfill the disclosure obligation arising from Article 10 of the Law on the Protection of Personal Data No. 6698 (“KVKK”) (6698 sayılı Kişisel Verilerin Korunması Kanunu) and the Communiqué on the Procedures and Principles to be Followed in Fulfilling the Obligation to Inform (Aydınlatma Yükümlülüğünün Yerine Getirilmesinde Uyulacak Usul ve Esaslar Hakkında Tebliğ) by Electravis Teknoloji A.Ş. (“Solarvis”). Transparency and accountability are important for Solarvis. In this context, this Clarification Text has been prepared solely for the purpose of informing visitors and customers of the Website (İnternet Sitesi) in accordance with the legislation and does not cover the processing of personal data of employees, employee candidates, suppliers, and similar groups of persons.
Within the scope of the KVKK, personal data means any information relating to an identified or identifiable natural person (kimliği belirli veya belirlenebilir gerçek kişi). According to the provisions of the KVKK, the natural or legal person who determines the purposes and means of processing personal data, and who is responsible for establishing and managing the data recording system, is referred to as the data controller (veri sorumlusu). Within the scope of the KVKK, your personal data relating to the transactions you carry out via the website with the domain name https://www.solarvis.co/ (“Website”) will be processed by Solarvis, as the data controller, for the purposes, scope, and legal reasons set out below. In this context, this Clarification Text includes information on the identity of the data controller and, if any, its representative; the purposes for which personal data will be processed; the persons to whom personal data may be transferred and the purposes of such transfer; the method and legal reason for collecting personal data; and other rights of the data subject listed in Article 11 of the KVKK.

Solarvis may update this Clarification Text in the event of amendments to the applicable legislation, decisions of the Personal Data Protection Board (Kişisel Verileri Koruma Kurulu), judicial decisions, changes in the methods, purposes, or reasons for processing and/or transferring personal data, or similar developments. If the Clarification Text is updated, the updated text will be published on the Website. Within the scope of its personal data processing and/or transfer activities, Solarvis may publish other clarification texts, rules, terms, or other explanations via the Website. 2. Methods of Collecting Personal Data and Legal Grounds for Processing Personal Data

Your personal data is processed by Solarvis in compliance with the provisions of the Constitution of the Republic of Turkey (Türkiye Cumhuriyeti Anayasası), the Law on the Protection of Personal Data No. 6698 (“KVKK”) (6698 sayılı Kişisel Verilerin Korunması Kanunu), the Law on the Regulation of Electronic Commerce No. 6563 (6563 sayılı Elektronik Ticaretin Düzenlenmesi Hakkında Kanun), the Turkish Penal Code No. 5237 (5237 sayılı Türk Ceza Kanunu), and other applicable legislation. Within the scope of the services provided by Solarvis, your personal data is processed:

- In accordance with the law and the principles of good faith,
- Accurately and kept up to date,
- For specific, explicit, and legitimate purposes, and
- In a manner relevant, limited, and proportionate to the purposes for which it is processed
and stored only for the period prescribed by the laws or required for the purpose of processing personal data, based on the conditions set out in Articles 5 and 6 of the KVKK.
Personal data you share with Solarvis, primarily through the forms available on the Website (İnternet Sitesi), will be processed in compliance with the applicable legislation, in connection with and limited to our field of activity and service purposes, may be transferred to third parties when necessary, and will be stored for periods permitted by law. Solarvis may collect personal data through website service providers, intermediary service providers, social media accounts, cookies, call centers, notifications from administrative and judicial authorities, and other communication channels; in visual, audio, physical, electronic, oral, or written form; for the purposes of establishing a commercial relationship, providing a quotation, entering into a contractual relationship, fulfilling obligations arising from laws, and/or within the framework of its legitimate interests, in accordance with the personal data processing conditions set out in the KVKK and the legal grounds specified in this Clarification Text.

Solarvis uses “cookies” (çerezler) to help personalize your online experience and to enable you to log in to our services. Through the Website, Solarvis collects personal data via cookies for various purposes. Cookies are text files placed on visitors’ computers by websites they visit. They are widely used by almost all websites to ensure efficient operation, to tailor functionality to visitors’ preferences, and to provide information to website administrators. Cookies are used to determine our visitors’ preferences, to identify requests for specific pages, to enhance the Website usage experience, to keep our services secure, and to carry out online behavioral advertising activities for our users. Most web browsers are set to accept cookies automatically by default. If you do not wish to allow the use of these tools, you can disable them through your browser settings. Your personal data is also used to communicate with you. This may include sending welcome emails, survey and forum notifications, information about technical service issues, and security announcements, as well as certain mandatory service communications.

When you fill out forms on the Solarvis Website, your personal data will also be processed in accordance with the purpose of filling out the form and, if you have separately given consent to receive commercial electronic messages, solely for the purpose of providing you with information about the services via email or SMS.

3. Processed Personal Data

The personal data processed may vary depending on the nature of the legal relationship you have established with Solarvis. However, in general, the personal data we process are as follows:

3.1. Identity Information

Your name, surname, Turkish ID number, and identity document details that you provide when registering on the Website (İnternet Sitesi), when conducting transactions via the Website to benefit from our products and services, during calls made through the call center, and in all kinds of applications you submit.

3.2 Contact Information

Your email address, landline number, mobile phone number, and address details that you provide when registering on the Website, when conducting transactions via the Website to benefit from our products and services, during calls made through the call center, and in all kinds of applications you submit.

3.3 Financial Information

Credit/debit card information, bank account information, IBAN details, balance information, receivable balance, and other financial information.

3.4 Marketing Information

Reports indicating the preferences of the individual for marketing purposes, targeting information, cookie records (çerez kayıtları), information derived from data enrichment activities, surveys, campaigns, and information and evaluations obtained as a result of direct marketing activities.

3.5 Transaction Security Information

IP address information, password and passcode information, cookie information (çerez bilgileri).

3.6 Other Information

Legal transaction and compliance information (such as information requests from judicial and administrative authorities) and location information.

4. Reasons and Purposes for Processing Personal Data

Your personal data may be processed without explicit consent in cases permitted under applicable law, such as when required by legislation, necessary to protect life or physical integrity, directly related to the establishment or performance of a contract, necessary for the fulfillment of the data controller’s legal obligations, made public by the data subject, required for the establishment, exercise, or protection of a right, or necessary for legitimate interests provided that fundamental rights and freedoms are not harmed. In other circumstances, it will be processed only with explicit consent.

Solarvis processes personal data to enable you to benefit easily and securely from its products and services, tailor offerings to your needs and usage habits, manage financial and accounting operations, carry out advertising, campaign, and promotion activities, maintain storage and archiving, manage customer relationships, conduct sales and marketing activities, fulfill legal obligations, manage reporting processes, provide information to authorized persons, institutions, and organizations, and ensure legal processes are handled efficiently. Data is also processed to identify and verify website users, detect and resolve service issues, evaluate and address customer requests, complaints, and suggestions, and fulfill obligations arising from applicable legislation.

As a rule, Solarvis does not process special categories of personal data, except those related to employees.

5. Solarvis’s Rights and Obligations

Personal data shared with Solarvis is under its supervision and control. Acting as the data controller, Solarvis is responsible for establishing the necessary organization and implementing and adapting technical measures to protect the confidentiality and integrity of information in accordance with applicable legislation. Your personal data will be processed within the scope of Solarvis’s business activities and for the purposes set out in this Clarification Text, stored for as long as required by the purposes of processing and/or by applicable legislation, and—unless a legal retention obligation exists—deleted, destroyed, or anonymized automatically or upon the request of the data subject once the reasons for processing no longer apply. Processing and storage are carried out only by authorized and trained personnel in secure environments.

Various security technologies and procedures are used to help protect personal information against unauthorized access, use, and disclosure. Your data is stored on computer systems with limited access in controlled facilities, and highly confidential information such as credit card numbers or passwords is encrypted during online transmission using methods such as the Secure Socket Layer (SSL) protocol.

The following measures are taken by Solarvis regarding the processing of personal data:

5.a. Administrative Measures

- Personal data is minimized as much as possible.
- Access rights in this field are revoked for employees who change roles or leave the company.
- Corporate policies on the protection of personal data have been established and are implemented.
- Training and awareness programs are conducted to inform employees about the protection of personal data.

5.b. Technical Measures

- Network and application security are ensured.
- Necessary security measures are taken regarding entry to and exit from physical environments containing personal data.
- The security of physical environments containing personal data is ensured against external risks (such as fire, flood, etc.).
- A user account management and access control system is implemented, monitored, and subjected to periodic and/or random internal audits.
- Security measures are applied in the procurement, development, and maintenance of information technology systems.
- Up-to-date antivirus systems and firewalls are used.

In accordance with Article 4 of the KVKK, Solarvis is obliged to keep the personal data of data subjects accurate and up to date. To fulfill this obligation, our customers must provide Solarvis with accurate and up-to-date information. In the event that your personal data changes in any way, you should update your information by visiting your profile page.

6. Transfer of Personal Data

The sharing of personal data with third parties takes place in accordance with applicable legislation and/or the explicit consent of the data subject. However, due to legal obligations and only to that extent, personal data may be shared with courts and other public institutions. In addition, to provide services and carry out quality control of those services, personal data may be transferred to third parties within the scope of a contractual relationship. Technical and administrative measures are taken during transfers to third parties to prevent data breaches.

Your personal data may be shared with program partner institutions and organizations with which we cooperate to carry out our activities; third parties acting as service providers and/or intermediary service providers; business partners providing private integrator services; independent audit firms; domestic or foreign persons and institutions providing cloud data storage services; domestic or foreign organizations with which we have agreements to send commercial electronic messages to our customers; our financial advisors; the Interbank Card Center; contracted banks; payment service providers; other domestic or foreign third parties; our business partners, shareholders, and affiliates; third parties from which we receive services under a contractual relationship; our lawyers and consultants; and legally authorized public institutions and private legal entities.

7. Rights of the Data Subject

Under Article 11 of the KVKK, the data subject has the right to:– Learn whether personal data concerning them is being processed
– Request information if personal data concerning them has been processed
– Learn the purpose of processing personal data and whether it is used in accordance with its purpose
– Know the third parties, in Turkey or abroad, to whom personal data has been transferred
– Request the correction of personal data if it is incomplete or inaccurate
– Request the deletion or destruction of personal data if the reasons requiring its processing no longer exist, even if it has been processed in accordance with the KVKK and other relevant legislation
– Request notification to third parties to whom personal data has been transferred regarding the correction, deletion, or destruction of personal data
– Object to the occurrence of a result against them by means of analyzing processed data exclusively through automated systems
– Request compensation for damages in case of suffering damage due to unlawful processing of personal data

To exercise these rights, you may submit your request in accordance with Article 13 of the KVKK and the Communiqué on the Principles and Procedures for Application to the Data Controller, by delivering it in writing to Solarvis at “Mustafa Kemal Mah. ODTÜ Teknokent Bilişim İnovasyon Merkezi 280/G No:1260 Çankaya / ANKARA”, including your name, surname, and signature; your Turkish ID number if you are a citizen of the Republic of Turkey, or your nationality, passport number, or identity number if you are not; your residential or business address for notification purposes; your e-mail address and telephone number for notification; the subject of your request; and any necessary information and documents to verify your identity, and/or by using the Application Form. You may also apply via the e-mail address registered to your membership, or—if you do not have a membership—by e-mail for general inquiries regarding the KVKK. Your application will be evaluated by Solarvis and finalized free of charge within thirty days; however, if the process incurs an additional cost, a fee may be charged according to the tariff determined by the Personal Data Protection Board.
